Terms of Service

These Terms of Use constitute a legally binding agreement between you and TrackMyMoney ("TMM," "we," or "us") regarding your use of our services.

By using our services, you acknowledge that you have read, understood, and agree to be bound by these terms. These terms will remain in effect throughout your use of our services.

We reserve the right to modify these terms at any time. We will notify you of any material changes by:

• Posting a notice on our website
• Sending you an email notification
• Providing notice through our application

Your continued use of our services after such modifications will constitute your acknowledgment and agreement to the modified terms.

Our services are not intended for individuals under 18 years of age. We do not knowingly collect personal information from children under 18.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRACKMYMONEY, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD-PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; AND (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF TRACKMYMONEY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNT YOU PAID TRACKMYMONEY, IF ANY, IN THE LAST SIX (6) MONTHS FOR THE SERVICES.

You agree to defend, indemnify, and hold harmless TrackMyMoney and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.

YOU AND TRACKMYMONEY AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF THE SERVICES WILL BE SETTLED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") UNDER ITS COMMERCIAL ARBITRATION RULES. THE ARBITRATION WILL BE CONDUCTED IN WILMINGTON, DELAWARE, IN THE ENGLISH LANGUAGE. JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR(S) MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF.

CLASS ACTION WAIVER: YOU AND TRACKMYMONEY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

These Terms and any action related thereto will be governed by the laws of the State of Delaware, United States, without regard to its conflict of laws provisions. For any dispute not subject to arbitration, you and TrackMyMoney agree to submit to the personal jurisdiction of the state and federal courts located in Wilmington, Delaware.
